That statement doesn't make sense to me Flik. People get charged with fraud all the time, with no intent to physically harm someone. Even using a stolen credit card will get you charged with fraud.

I had to copy your link so I could try and understand your statement with a little more clarity.

This isn't statute, it's just an explanation; albeit piss-poor.
It's still too vague to be acceptable.

Ooo, good question! I would say no because the circumstances of her death would be different. It implies that the two had an amiable relationship to begin with. This woman started the relationship with the intent to harm, though not kill, said girl. Just my thoughts.

To the people arguing the definition of "fraud" you seemed to a missed a hugely important point.

Lori is being charged with fraud and hacking of myspace, not fraud against the 13 year old.

The alleged "victim" in this case is myspace.

So based on the 5 points already mentioned.

1. Guilty, she lied about name, age etc..
2. Guilty, she knew it was untrue.
3. Guilty, she was trying to decieve.
4. NOT Guilty, myspace doesnt rely or really care about the data, she would have gotten a myspace account no matter what details she gave.
5. NOT Guilty, she didnt injure myspace in any way.

I'm going to have to disagree with you. If you charge an older person, then you'd have to charge the young people who do the very same thing.

As a child.. well, let's just say I wasn't the most intelligent when it came to certain things. A few girls actually tried to be my friends for the sole purpose of trying to hurt me in the end. Granted, I didn't kill myself over this, but I also didn't have any strong emotional and mental problems at the time.

The way I see it.. the most they should be able to do is ban her from MySpace for violating the TOS, if there is anything in the TOS about what she did. Beyond that, imagine how many people on ShoutWire could be charged for exactly that if they made an off comment to someone who was already mentally and emotionally disturbed enough to commit suicide over the simple comment?

As to those claiming this is fraud and comparing it to credit card fraud. In the case of the Credit Card.. we have the Credit Rating. Let's say you stole someone's credit card, even without the knowledge of this so called Credit Rating. Conceivably, you could be taking that credit card with the malicious intent on destroying said Credit Rating. Thus linking this act to fraud as it has the intent on personal injury as said Credit Rating controls Interest Rate that one would receive, and conceivably, the banks could jack up interest rates on a Mortgage or Loan the person has making it impossible for them to pay it, thus resulting in the loss of personal property by the direct result of your stealing the credit card and using it.

In the case of the false identity online, the only way it could be conceived as fraud is if it was done with the sole purpose of deceiving someone into giving you something, doing something or simply to get something that you'd otherwise have to pay for. Otherwise, considering we all use "false identities" in ShoutWire to post under(how many of you are willing to put your real name and other pieces of identity online for all to see?), how many of us could be charged with fraud if they, as was stated in the article(I believe) and in a few comments, couldn't get anything else to stick but believed we should be charged with at least something in the name of revenge?

True, what that woman did was stupid and wrong. If she has even a remote piece of Humanity left in her, she'll feel the guilt of what she did for the rest of her life. Either way, that woman needs to seek professional help for what she did.

As for the girl. It's sad what happened to her, but why should I feel sorry for this? I was bullied and teased all my school life and yet I'm still here. I was pushed to the point where I faked sick for the first 2 weeks of school just go get out of going, but I still wasn't pushed to suicide. Eventually I learned to deal with these bullies by realizing what others think and say about me means absolutely nothing. If they get their jollies off of intentionally trying to hurt people, it simply means they are incredibly damaged to begin with and if they don't get help, the rest of their life will be torture enough for the "crimes"(I use that loosely) they commit.

I'll say this, I do know where people are coming from with their emotional stand points. Yes, this woman deserves to get what's coming to her. But, what's coming to her should be a life long feeling of guilt. Without knowing the exact details of the conversations had between the woman and the girl, I can tentatively say that the woman broke no laws. However, if it so happens to be that the woman did break laws during those conversations, then yes, she deserves to be charged with breaking those laws. But, from the sounds of it, it seems as if they won't be able to prove that she did break any law and are using the "hacking" charge to get her with at least something.
